The promoter is Fraser Motorcycles Sydney, Motor Dealer License: MD27, MVRL8930, of 153-165 Parramatta Road, Concord NSW 2137. The Promotion commences at 12:01am AEST on the Commencement Date of 20th October 2023 and ends at 11:59pm AEST on the End Date of 17th April 2024. Entrants are ineligible to participate outside the Promotion Period. During the Promotion, Eligible Entrants can only complete entry by submitting an entry form on the Fraser Motorcycles Website. By entering this competition, you agree to the Fraser Motorcycles PRIVACY POLICY and to receive email marketing. Demo ride must be completed to qualify. Winner announced after 17th April 2024.

Entrants must meet the following criteria to participate in the Promotion: be 16 years or over; provide a valid email address; be a permanent resident of Australia, or have resided in Australia continuously for six months or more on a temporary work visa at the time of participating in the Promotion; hold a NSW residential address only; not be an officer or employee of Fraser Motorcycles Sydney and their elated bodies corporate, or their immediate family; and not be an officer or employee of any agents or service providers of Fraser Motorcycles Sydney and their related bodies corporate, or their immediate family, directly associated with the conduct of the Promotion.

Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.

Eligible winner will be notified via their nominated email address or phone number within 10 business days of the promotion ending. A Prize will be deemed unclaimed if Fraser Motorcycles Sydney is not reasonably able to contact the Eligible Winner within three (3) months and one (1) day of the Draw Date via the Eligible Winner’s provided contact details.

The prize will be supplied by Fraser Motorcycles.

The Major Prize must be collected where it is available at the closest dealership, nominated by Fraser Motorcycles. The prize may not be immediately available for collection at the nominated dealership. Once the Prize has been collected from the dealership, Fraser Motorcycles take no responsibility for the Prize being damaged, lost or stolen. The Eligible Winner is responsible for transport to and from the nominated dealership and any other costs associated with collecting the Motorcycle.

The Motorcycle is new, and the exact type and colour of the Motorcycle will be determined in the sole and absolute discretion of Fraser Motorcycles at the time of collection, which will depend on availability at the time. Additional expenses that are not included with the Prize as specified in these Terms and Conditions, such as petrol, comprehensive insurance and all other ancillary costs are the responsibility of the Eligible Winner. The prize will be registered in NSW.

If the Eligible Winner is not available to collect the Motorcycle from the nominated dealership, the Eligible Winner can seek alternative transport at their own expense.

The Eligible Winner must ensure they hold all required State or Territory licences required to collect and operate the Motorcycle. If the Eligible Winner of the Motorcycle is under the age of 18 years, the Eligible Winner must be accompanied by their parent or legal guardian at the time of the collection. If the Eligible Winner is not available to collect the Motorcycle from the nominated dealership, the Eligible Winner can seek alternative transport at their own expense.

In the event the Eligible Winner is unable to register the Motorcycle in their own name (included but not limited to licence suspensions or invalid licence), then the Eligible Winner must nominate an alternative person (who must hold a valid licence) to register and transfer the Prize to. Fraser Motorcycles will require the signature of a valid agreement to document the Eligible Winner’s authorisation to transfer the Prize. Following such transfer, Fraser Motorcycles are not liable for any further costs associated with the Prize other than those listed in these terms and conditions.

The Prize or any portion of the Prize is not transferable or exchangeable unless specified in these Terms and Conditions and cannot be taken as cash.

The Eligible Winner will participate in all reasonable promotional activities in relation to the Promotion, as requested by Fraser Motorcycles and its agents or related bodies corporate. This may include the Eligible Winner’s name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media worldwide for whatever purpose and without notification, remuneration or compensation, for marketing and or promotional purposes, for an indefinite period. The Eligible Winner consents to Fraser Motorcycles publishing the Eligible Winner’s name and postcode on its website or any other media.

This Promotion is not available in conjunction with any other promotion or offer.

Fraser Motorcycles reserve the right to disqualify any person from entering the Promotion, or receiving a Prize, if any of the following occurs: If it suspects fraudulent activity; or for a breach of these Terms and Conditions; or if it decides the person has not acted in good faith (including but not limited to using automatically generated entries or multiple aliases; or for any false or misleading conduct of any kind.

Fraser Motorcycles reserves the right at its discretion or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion at any time without notice. Unless prohibited by law, these Terms and Conditions may be varied at any time without notice. Fraser Motorcycles reserves the right to substitute any Prize with another incentive of the same value, subject to regulatory authority. Prizes are not refundable, reloadable, transferable or exchangeable and cannot be taken as physical cash.

Fraser Motorcycles reserves the right to request that an Eligible Entrant provides supporting documentary evidence of their identity (e.g. driver’s licence, passport, birth certificate). If the Eligible Entrant fails to do so, or Fraser Motorcycles determines the insurance policy does not meet the eligibility criteria of the offer, the Eligible Winner will not be eligible for the Prize.

Fraser Motorcycles and/or Insurer (including their officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any theft, unauthorised access, third party interference, any technical difficulties or equipment malfunction, or personal injury or death (including loss of opportunity) suffered or sustained in connection with the Promotion, or the receipt, acceptance, or use of the Prize (whether negligent or not), except for any liability that cannot be excluded by law.

Fraser Motorcycles does not accept any responsibility whatsoever for any tax liability associated, connected with or arising from the Promotion unless specified within these Terms and Conditions. Entrants should obtain independent financial advice regarding any financial or tax implications that may arise as a result of receiving the Prize.

If there is a dispute regarding the conduct of the Promotion, Entrants agree that the decision of Fraser Motorcycles will be final.

In these Terms and Conditions:
“Personal Information” means, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.

Entry into the Promotion and any offer of Fraser Motorcycles Sydney is subject to the Insurer deeming that the risk is acceptable in accordance with its underwriting criteria.
